After the period of presentation of the Income Tax Return

, the figure of the tax advisor charges continues to gain prominence. The continuous changes to which the Administration subjects the tax laws and the complexity of them make almost everyone suffer headaches when they start to fill out all kinds of taxes and end up putting themselves in the hands of an expert.

However, the tax advisor is much more than that person who helps to comply with the Treasury, because he has many other functions.

What does a tax advisor do?

The work of the expert in Taxation encompasses many fields. To begin with, you must be permanently studying if you want to be up to date with the abundant legal developments that Tax Law includes every year, a task that you must combine with the attention to your clients, the real reason for your work.

And this leads to talk about the primary function of the advisor: to make his aforementioned clients achieve maximum tax savings. But – and this is a priority – always within the law,as it could not be otherwise.

The reason for its activity is based on two basic principles.

In the first place, “We are all treasury” (according to the slogan) and, therefore, citizens have to comply with their tax obligations. It is the only way to, for example, have good hospitals and doctors, have children receive a quality education or have modern roads built.

But, in addition, because tax fraud is punishable by high fines and, even from a certain amount of money, with prison sentences for the offender (by the way, that the latest jurisprudence also defends the punishment of the tax advisor).

However, so far it has been mostly about the relationship of the
tax advisor
with individuals. But, if the advisor is necessary for these, it is even more so for the self-employed and companies.

These, together with their tax obligations, usually have to keep accounting books and even, in the case of companies, present their accounts annually in the Mercantile Registry of their province, a not easy task that almost always requires an expert advisor.

Advantages for companies and freelancers of having a specialist in tax advice

Thus, we link with more complex functions of the advisor, which have to do with the business world since, if the legislation is cumbersome for individuals, it is even more so for companies, whether they are a small business or an SME (especially with respect to the latter).

However, for the self-employed, the tax expert is even more important, if possible, than for companies. Because it should not be forgotten that the former are responsible for their debts with their personal assets and a serious mistake before the Treasury can leave them in ruins.

Both to them and to SMEs, the advisor offers two types of service: prepare their accounting, make their statements and complete their books or supervise the performance of these works by companies correcting errors and providing their advice.

However, in either case, the advisor has several obligations. By carrying an order we will say that the first is develop the appropriate tax planning of the business of the self-employed or the company according to their tax obligations in such a way that, always within the law, they have to pay as little as possible or, at least, do it in a fractional way and, consequently, more comfortable.

Also advise and, where appropriate, complete the declarations that the company or business must submit to the Treasury, such as the management of VAT deferrals.

And this not only refers to the Central Administration, but also to the autonomous and municipal ones.

This leads to another function of the tax advisor: that of representing his clients in case of inspections and in any other management before the Tax Agency, either the simple delivery of a document or a thorough review of their accounts at the request of the aforementioned body. And, in case problems arise, propose the most advantageous solutions for your advisor, sometimes even negotiating with the Administration.

Finally, it is also the usual functions of the advisor to plan the most appropriate for his client in case of property transfers, guidance when hiring a retirement plan or a savings system and – in cases of international trade – advising you on how to follow the guidelines of customs legislation.

In short, the task of the tax advisor is broad and complex. But, as far as your customers are concerned, it is always advantageous to have him.

In fact, at Ayce Consultores we offer advisory services at an affordable price for all budgets. In any case, the sanction that the entrepreneur can face is always more expensive if, even if it is by mistake, he does not pay the Treasury everything that the law obliges him.
