The Supreme Court has asked the Court of Justice of the European Union to rule on the tax on large areas in Catalonia, Aragon and Asturias. This request would have been raised by the Association of Large Distribution Companies, so it has suspended the processing of the appeals of this association, until the high court pronounces.

The Third Chamber of the Supreme Court has on several occasions raised orders with the preliminary ruling to the Court of Justice of the European Union so that it clarifies the doubts about the adequacy or not of the tax on large commercial establishments that exists in Catalonia, Asturias and Aragon according to the Treaty on the Functioning of the European Union.

Among the appeals of the National Association of Large Distribution Companies (ANGED) was included the request to raise the issue to the Court of Justice of the European Union against the judgments of the superior courts of Justice of Catalonia, Asturias and Aragon in relation to such taxes.
