What is meant by a situation of harassment at work?

Harassment at work refers to any type of repeated verbal or physical behavior that, by action or omission, has the purpose of attacking the dignity of one or more workers, creating an environment of defenselessness, intimidation, degrading and offensive.

Within a company there can be different types of harassment:

  • Sexual harassment:any behavior, verbal or physical, of a sexual nature, that has the purpose or produces the effect of violating the dignity of a person. Particularly when an intimidating, degrading or offensive environment is created.
  • Harassment based on sex:any behavior carried out based on the sex of a person, with the purpose or effect of violating their dignity, and of creating an intimidating, degrading or offensive environment.
  • Moral harassment or labor mobbing:any aggression carried out by one or more people verbally, psychologically or physically, with the intention of humiliating and harassing.

Why does your company need a workplace harassment protocol?

Organic Law 3/2007, of March 22, for the effective equality of women and men, expressly prohibits sexual harassment at work and harassment based on sex,defining the following behaviors:

Article 48 of the aforementioned Organic Law 3/2007, of 22 March, establishes that undertakings shall promote working conditions that prevent sexual harassment and harassment on grounds of sex and shall provide specific procedures for prevention of labor mobbing,as well as to channel complaints or claims that may be made by those who have been the subject of it.

The goal of a The protocol for the prevention of workplace harassment is to define the guidelines that allow the identification of a situation of harassment within the company (moral, sexual, gender-based harassment, as well as discrimination based on pregnancy or maternity),in order to solve a discriminatory situation and minimize the possible consequences,and thus guarantee the rights of the people affected.
