Approved the calendar of non-working days corresponding to the year 2019, for the General Administration of the State and its Public Bodies, for the purposes of computations of deadlines.

Calculation of deadlines: calendar 2019

Last October, the calendar of non-working days was approved for the purpose of calculating deadlines, subject to the official work calendar.

Therefore, these are non-working days:

  • Throughout the national territory: Saturdays, Sundays and days declared as national holidays not substitutable, or on which all the Autonomous Communities have not exercised the power of substitution.
  • In the territorial scope of the Autonomous Communities: those days determined by each Autonomous Community as holidays.
  • In the territorial areas of the Entities that make up the Local Administration: the days established by the respective Autonomous Communities in their corresponding calendars of non-working days.

JANUARY: Every Saturday and Sunday of the month.

  • Day 1: Inhosnable throughout the national territory.
  • Day 7: Inhábil in the AUTONOMOUS COMMUNITIES: Andalusia, Aragon, Asturias, Canary Islands, Extremadura, Murcia, Castilla y León, Madrid, Navarra, City of Ceuta and City of Melilla.

FEBRUARY: Every Saturday and Sunday of the month.

  • Day 28: Inhábil in the AUTONOMOUS STATE of Andalusia.

MARCH: Every Saturday and Sunday of the month.

  • Day 1: Inhábil in the CC.AA. of Illes Balears.
  • Day 19: Inhábil in the AUTONOMOUS COMMUNITIES of: Galicia, Murcia, Basque Country, Valencia and Navarra.

APRIL: Every Saturday and Sunday of the month

  • Day 18: Inhábil in the AUTONOMOUS COMMUNITIES of: Andalusia, Aragon, Asturias, Balearic Islands, Canary Islands, Cantabria, Castilla-La Mancha, Extremadura, Galicia, Murcia, Basque Country, La Rioja, Castilla y León, Madrid, Navarra, City of Ceuta and City of Melilla.

JULY: Every Saturday and Sunday of the month.

  • Day 25: Inhábil in the AUTONOMOUS COMMUNITIES of: Cantabria, Galicia and the Basque Country.

AUGUST: Every Saturday and Sunday of the month.

  • Day 12: Inhábil in the City of Ceuta and in the City of Melilla.
  • Day 15: Inhosnable throughout the national territory.

SEPTEMBER: Every Saturday and Sunday of the month.

  • Day 2: Inhábil in the City of Ceuta.
  • Day 9: Inhábil in the CC.AA. of: Asturias and Extremadura.
  • Day 11: Inhábil in the AUTONOMOUS REGION of Catalonia.

OCTOBER: Every Saturday and Sunday of the month.

  • Day 9: Inhábil in Valencia.
  • Day 12: Inhosnable throughout the national territory.

NOVEMBER: Every Saturday and Sunday of the month.

  • Day 9: Inhábil in the autonomous communities of: Andalusia, Aragon, Asturias, Cantabria, Extremadura, La Rioja, Castilla y León, Madrid and in the City of Melilla.
  • Day 25: Inhábil throughout the national territory.
  • Day 26: Inhábil in the CC.AA. of: Illes Balears and Cataluña.

There will also be work holidays in the following autonomous communities on the following days:

Canary Islands

  • El Hierro: September 24, feast of Our Lady of the Kings;
  • Fuerteventura: September 20, feast of Our Lady of the Rock;
  • Gran Canaria: September 9, Monday after the feast of Our Lady of the Pine;
  • Gomera: October 7, feast of Our Lady of Guadalupe;
  • La Palma: August 5, feast of Our Lady of the Snows;
  • Lanzarote: September 16, Monday after the feast of Our Lady of Sorrows;
  • Tenerife: February 2, feast of the Virgin of Candelaria.

Catalonia

  • The feast of December 26 (San Esteban) is replaced by that of June 17 (Feast of Aran).

Calculation of deadlines and extension thereof

The terms and deadlines established are binding on the Administration and the interested parties. Its computation is carried out as follows:

  • Time limits fixed by hour. Unless by law or in EU law another calculation is provided for, when the deadlines are indicated by hours, it is understood that these are skillful. All hours of the day that are part of a business day are working. The time limits expressed by hours are counted from hour to hour and from minute to minute from the hour and minute in which the notification or publication of the act in question takes place and may not last more than twenty-four hours, in which case they shall be expressed in days.
  • Time limits fixed by days. Provided that by law or by European regulations it is not otherwise, when the deadlines are indicated by days, it is understood that these are working, excluding from the computation saturdays, sundays and declared holidays.
    The initial day of the calculation is from the day following that on which the notification or publication of the act in question takes place, or from the day following that on which the estimate or rejection by administrative silence takes place.
  • Time limits fixed in months or years. If the time limit is fixed in months or years, these must be taken into account from date to date, so that even if the calculation begins from the day following that on which the notification or publication of the act in question takes place, or from the day following the estimate or rejection by silence , the final day of the deadline in the month of expiration is the equivalent of the day of notification or publication in the initial month.

When the last day of the period is incapable,it is understood to be extended to the first following working day; in the periods indicated by months or years, if in the month of expiration there is no day equivalent to the initial one of the computation, it is understood that the term expires on the last day of the month.

The last day of the deadline must be counted in its entirety, the time data being irrelevant; so that the submission of writings outside the registration hours can be done at the post office. It is not possible to present written documents addressed to the economic-administrative bodies in the Court on duty, being unusual that it is not inadmissible.

If a working day is in the municipality or Autonomous Community in which the interested party resides and incapable at the headquarters of the administrative body, or vice versa, it is considered inability in any case.
